Protecting your private information is our priority. This Privacy Policy applies to the CRBDIRECT.ORG.UK website a trading style of Elucidate Contractor Services (ECS) Ltd trading as ECS Ltd (“ECS”) and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to ECS include CRBDIRECT.ORG.UK. The CRBDIRECT.ORG.UK website (the “Site”) is a website through which ECS provides an application review and submission service. By using the Site, you consent to the data practices described in this statement. Elucidate Contractor Services (ECS) Limited is the data controller for the purposes of the Data Protection Act 2018.

Collection of your Personal Information

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

ECS may collect, use, store and transfer different kinds of personal data about you. These have been detailed as follows:

  • Identity Data includes, first name, maiden name, last name, marital status, title, date of birth, gender, national insurance number, driving licence details, national entitlement card number, passport number.
  • Contact Data includes, current and previous addresses, email address and telephone numbers.
  • Financial Data includes, bank statements (credit card, mortgage), government tax statement.
  • Transaction Data includes, details of products and services you have engaged us for.
  • Technical Data includes, internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
  • Usage Data includes, information about how you use our website, products and services.
  • Marketing and Communications Data includes, your preferences in receiving marketing from us and our third parties and your communication preferences.

ECS also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

ECS do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). ECS may on occasion, collect but not store information about criminal convictions and offences in the context of the CRB certificate to be provided.

 

Use of your Personal Information

ECS rely upon your consent given by way of our Terms and Conditions in order to provide you with our service (i.e. application for a CRB check).

ECS will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract, we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

Your Data Rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to:

  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. Requesting a copy of your Personal Data

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. We may also charge a further administrative fee when you request for us to provide further copies of the information already provided to you.

We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate. Security of your Personal Information

ECS secures your personal information from unauthorised access, use or disclosure. When personal information (such as a credit card or debit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. ECS does not collect payment information and at no point receive and therefore store the credit/debit card information. Customers of the Site are redirected to a third-party payment gateway to submit a payment. While we use industry standard procedures to safeguard your PII once we receive it, no transmission of data over the internet or any other public network can be guaranteed to be 100% secure.

 

Storage of your Personal Information

ECS will only retain your personal data for as long as necessary to fulfil the purposes ECS collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal data, ECS consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether ECS can achieve those purposes through other means, and the applicable legal requirements.

Children Under Sixteen

The site is not directed to children under the age of 16 however, and ECS does not knowingly collect PII from children under the age of 16. If you are under the age of 16, it must be stressed and made clear that you are not permitted to use the site
